Return & Refund Policy
All Sales Are Final
Due to alcohol regulations, all sales are final.
Once an order is placed and shipped, it cannot be cancelled, returned, or refunded unless the product is damaged in transit and shipping insurance was purchased.
Order Cancellations
If your order has not yet shipped, you may request a cancellation.

Approved cancellations are subject to a 10% cancellation fee.

Once an order has shipped, it cannot be canceled.
Refunds for Returned Packages (Failed Delivery)
If UPS returns your package to us because:

No adult (21+) was available to sign

The package was refused
-
The address was incorrect or undeliverable

Delivery attempts were missed
Then:

Shipping charges are non-refundable
-
Return shipping fees charged by UPS will be deducted

A 15% restocking fee will be deducted
-
Only the product cost (minus all deductions) will be refunded after the item is returned to our warehouse in good condition
If you wish to have the package reshipped, you must pay a new UPS shipping fee.
Incorrect or Missing Items
If you received the wrong item or something is missing, you must notify us within:
3 business days of delivery.
We require:

Photos of the items received

A brief description of the issue
Requests made after 3 business days cannot be reviewed.
Damaged Items
If your order arrives damaged and you purchased shipping insurance:

You must notify us within 3 business days

Photos of the damaged product and packaging must be provided

The damaged product must be returned to be eligible for reimbursement
Without shipping insurance, Liquor On Broadway is not responsible for:

Damage in transit

Loss in transit

Weather-related damage

Leakage
Minor cosmetic imperfections or leakage are not covered.
Shipping Insurance
Shipping insurance (optional at checkout) covers:

Loss in transit (package never delivered)

Damage in transit
It does not cover theft, because UPS requires a 21+ adult signature and does not leave packages unattended.
If insurance is declined, the customer accepts full responsibility for loss or damage during transit.
Customer Responsibility & Legal Compliance
By placing an order, you confirm that:

You are at least 21 years old

You are legally allowed to receive alcohol in your state/county

You are purchasing for personal consumption only

You are complying with all applicable state, local, and federal laws

Someone 21+ will be available to sign for delivery
You agree to indemnify and hold Liquor On Broadway harmless from any legal issues, penalties, or costs related to the shipment of alcohol into your state.
Taxes
You are responsible for all taxes, including:

California sales tax (7.75% for CA deliveries)

Any state/local taxes required by the destination state
Title to Goods
Title to all items passes to you in California once UPS takes possession of the package.
At that point, liability transfers to the customer.
Limitation of Liability
Liquor On Broadway is not liable for:

Carrier delays

Missed delivery attempts
-
Incorrect addresses provided by the customer

Weather-related damage
-
Loss/damage when shipping insurance is declined

Indirect, incidental, or punitive damages
Your sole remedy is limited to the actual value of the product purchased.

Force Majeure
We are not responsible for delays or failed deliveries caused by:

Severability
If any part of this policy is found invalid, the remaining provisions will continue in full force and effect.
